1. Making the contract
Once the application has been made in writing by the client by ordinary
mail, fax or e-mail and once the corresponding confirmation or invoice
from movida events tenerife has been given a contract will necessarily
be drawn up. When a user is registered, he becomes a contractual partner
of movida events tenerife, and so successively with other users.
2. Payment
Once the contract is signed, the user will receive, together with the
confirmation of the reservation, an invoice with the corresponding entries.
On receiving this invoice, a payment will be made of 50%. The remainder
must be paid up to fourteen days before the start of the journey. In
the case of reservations in the period of fourteen days prior to the
start of the journey, the price of the trip must be paid in a single
payment. It will be necessary to make a payment of a larger sum of money
with certain services; in such cases, the client will be informed prior
to the signing of the contract.
Non-payment of the price of the trip within the space of time stipulated
does not bind the agency in the execution of services.
3. Services
The services contractually agreed refer to the description of services
which are listed in the corresponding confirmation of the application.
The services that feature are obligatory for movida events tenerife.
movida events tenerife expressly reserves the right to modify the services
described for good, considerable and unforeseeable cause, which cannot
be imputed to movida events tenerife. The client will be informed as
soon as possible. Additional agreements which are made verbally and
which extend the services vis-à-vis that which has been confirmed
according to the application will require written confirmation from
movida events tenerife in order to take effect.
4. Termination, changes
of date and modifications of particulars.
The client can terminate the contract at any time. The relevant declaration
must be made in writing by e-mail, fax or ordinary mail (counting from
the date of receipt). The global costs in case of termination for the
purposes of proper compensation for expenses and other possible outgoings
are the following:
On hotel reservations, transfers, excursions, evens and congresses:
- Between 90 days and 30 days prior to the beginning of the journey
20% of the price of the trip.
- From 29 days to 15 days prior to the beginning of the journey
35% of the price of the trip.
- From 14 days to 3 days prior to the beginning of the journey 50% of the price of the trip.
- From 2 days prior to the beginning of the journey 85% of the price of the trip.
- If the trip is not undertaken and there has been no formal cancellation,
100% of the price of the trip.
In some services, there are particular rules for cancellations of which
the client will be notified prior to the signature of the contract.
In the case of modifications of the dates of the journey there is also
a table. The modifications of details will be carried out free of charge
up to 30 days prior to the beginning of the journey; subsequently, a
management fee will be applied, which amounts to 25 Euros. As a reference
to make the calculations the date of the entry of the cancellation at
movida events tenerife will be taken. Only partial cancellations per
room may be carried out. For the remaining persons, it will be necessary
to reserve an accommodation with its corresponding voucher (in the case
of group reservations, it is possible to agree special conditions in
writing).
5. Modifications
Modifications or indispensable differences in some services with regard
to the content of the contract arising subsequent to the signing of
the contract and which in the view of movida events tenerife are not
carried out in good faith are only permitted as long as the modifications
or differences are not considerable and do not prejudice the totality
of the services contracted for. Possible guarantee pretensions will
remain intact while the modified services are not affected. movida events
tenerife is obliged to make any modification known to its clients immediately.
If the case arises, movida events tenerife will offer the client either
a free reservation or a free cancellation.
6.- Claims
The client is obliged in the case of possible alterations in the services
to do everything that appears reasonable to him in order to help to
eliminate the inconvenience and to reduce possible damages. The client
is especially obliged to direct his claims in writing and without delay
to movida events tenerife. No collective complaints will be considered.
Non-observance of these obligations will result in the loss of rights.
7.- Liability
Travellers may validate their rights with movida events tenerife within
the space of one month after the termination of the trip set out in
the contract. Services rendered by staff who do not belong to movida
events tenerife and advertisements are based solely on data from the
service provider given to movida events Tenerife.
The classification of hotels according to category is officially carried
out by the Spanish Ministry of Tourism. Furthermore, movida events tenerife
is not liable for differences which arise between the offers and the
concept of the clients in the case of inconvenience due to noise from
leisure premises, building work or road works, cars, planes or others.
The same applies to dirtiness on the beaches of all kinds as well as
to the cutting off of supplies of water or electricity.
8. Generalities
The invalidity of certain provisions of the contract does not lead to
the invalidity of the totality of the contract for the trip as a whole.
The same is true with the existing travel conditions. The competent
authority are the courts of Tenerife as this is the place of fulfilment
of the obligations.
